Welcome to Doctate. These Terms of Service govern your use of our platform and clinical documentation services. By accessing or using Doctate, you acknowledge that you have read, understood, and agree to be bound by these legal terms.
1. Acceptance of Terms
By creating an account, accessing, or using the Doctate SaaS platform (the 'Service'), you agree to comply with and be bound by these Terms of Service. If you are entering into these Terms on behalf of a medical practice or legal entity, you represent that you have the authority to bind such entity to these Terms. You must be 18 years of age or older to use the Service.
2. Description of Service
Doctate provides an AI-powered software-as-a-service platform designed to assist healthcare professionals in generating clinical correspondence, including referral letters, medical reports, and motivations, from dictated clinical notes and uploaded documentation. The Service acts as an administrative assistant and does not provide medical advice or clinical diagnoses.
3. User Accounts & Registration
To use Doctate, you must be a registered healthcare professional in good standing with your relevant regulatory body (such as the HPCSA). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or security breach.
4. Acceptable Use
You agree to use the Service in compliance with all applicable laws and ethical guidelines, including the Protection of Personal Information Act (POPIA) and any professional regulations regarding patient confidentiality. You may not use the Service to upload or process data for which you do not have the required patient consent or clinical authority.
5. Intellectual Property
Doctate retains all rights, title, and interest in the software, proprietary algorithms, and branding of the platform. Users retain ownership of the clinical data and patient information they upload. However, by using the Service, you grant Doctate a license to process this data solely for the purpose of providing, maintaining, and improving the Service features.
6. Limitation of Liability
Doctate is an AI-assisted administrative tool. The final clinical and legal responsibility for every letter, report, or motivation generated resides solely with the licensed healthcare professional. Doctate shall not be liable for any clinical errors, diagnostic inaccuracies, or adverse patient outcomes resulting from the use of content generated through the Service.
7. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms or for professional misconduct. Users may terminate their account via platform settings; however, accumulated fees or prepaid subscription balances remain subject to our standard billing policy and local consumer protection laws.
8. Changes to Terms
Doctate may update these Terms of Service from time to time to reflect changes in our service offerings or legislative environments. We will notify registered users of material changes via email or system alerts. Your continued use of the Service following such notifications constitutes agreement to the updated Terms.
9. Governing Law
These Terms, and any disputes arising out of or related to them, shall be governed by and construed in accordance with the laws of the Republic of South Africa. You agree to the exclusive jurisdiction of the South African courts for any legal proceedings relating to the Service.
